Subaru Sued by Daughter Who Lost Mother in Fatal Subaru Forester Rollover Accident

Minor Emma Thayer, through her father, Gregory Jones, is suing Subaru of America for the wrongful death of her mother, Lisa Ann Thayer. Lisa Ann Thayer was fatally injured and her daughter, Emma, personally and emotionally injured, when their Subaru Forester rolled over. Lisa died at the scene. The national automobile defect law firm Bisnar Chase is representing Emma Thayer. The case was filed on August 25, 2008 in the Superior Court of California, Orange County, Case #30-2008-00109807.
According to court documents, on October 27, 2006, Lisa Ann Thayer was properly restrained in her Subaru Forester, traveling at highway speeds north down Interstate I-40 in an unincorporated area of San Bernardino County, California. Suddenly the Subaru Forester veered onto the south paved shoulder, rotated clockwise and then swerved north across both lanes of traffic, into the desert. Before coming to rest on its roof, the Subaru Forester rolled over two full times, causing personal injuries to Emma Thayer and catastrophic and fatal injuries to her mother, Lisa.
The court documents state that the Subaru Forester was defectively manufactured, having an unsafe restraint system and insufficient lateral and roll stability. During the accident, the restraint system failed, ejecting Lisa Ann Thayer through the windshield, causing serious lacerations and fatal injuries. Her daughter, Emma, witnessed the entire incident.
In her lawsuit, Emma Thayer is seeking medical expenses, loss of past and future earnings and earning capacity; general damages including loss of wrongful death, personal injuries, pain and suffering and legal costs..
“I’ll never comprehend how automakers like Subaru can be so cold-hearted and profit-driven,” said Brian Chase, partner in Bisnar Chase. “A mere $ 100 more added to production costs for seatbelts that don’t tear would have made the Subaru Forester a safer car and a mother would be alive today for her young daughter.”
