Question by Mateo M: How long is the statute to report motor vehicle accidents in Idaho?
A friend wrecked my car almost 6 months ago. At the time, my vehicle was uninsured. The driver of my vehicle was uninsured and driving on a suspended license. I was not at the accident, but became involved when I arranged with the other driver that we would handle this directly with his insurance company.
Currently, the other motorist’s insurance company has taken a claim that holds me responsible for being the owner of the other vehicle involved in the accident and a settlement amount has been arranged.
There was no police report filed.
My vehicle has still not been fixed.
I want to file a police report regarding this accident.
In addition, I want to file a civil lawsuit to recoup damages.
What effects might this have if I filed an accident report as the owner of the vehicle, but not the driver?

The problem is I’m not trying to recoup anything from the other driver’s insurance company. I’m having problems recouping damages from the person that was driving my vehicle. My father has suggested I cut ties with this person, and pursue legal action against them. Since it has been 6 months and this person has not fulfilled their verbal commitment to take responsibility for this accident, regarding both the settlement with the insurance company, as well as the damages to my own vehicle, I have no other recourse but explore another avenue to protect myself in this matter. This person has had plenty of opportunity to work with me regarding everything, but to date, my car still sits at a mechanic shop awaiting payment to be repaired. The reason for filing a police report now, is to include this as part of the civil lawsuit, as well as provide the report to the other driver’s insurance company, which was originally requested. I was protecting this person by not filing a report.

You can file a police report at any time. However, a police report at this very late stage will probably do nothing. Also, as the owner of an uninsured vehicle, you may have a lot of trouble recouping anything, even in court.
Who was at fault in the accident? Your explanation isn’t clear. You say they are holding you responsible, does that mean they are placing you at fault? In that case, they won’t fix your car, in fact, you have to pay them for the damages to their insureds vehicle. Who will you be suing? Your friend?
If you are not at fault, then what is the reason they gave you for not fixing your car? If the other driver is at fault, they are required to pay you, whether or not you were uninsured.

Although you CAN file a police report now and you can sue at anytime up to the statute of limitations (usually 2 or 3 years) doing either now is not going to help you. You and your driver had no insurance so you are completely on your own. It is you against an insurance company and all of their lawyers. Since insurance companies are the ones who assess fault and you had no insurance, who do you suppose they found at fault? That’s right. You, the owner of the car. The person who let an unauthorized person drive an uninsured car. You need to see a lawyer to see if you have a case. Good luck…. I suspect you will need tons of it
There is no statute of limitations for reporting an accident. The statute for suing someone, is two years.
As the owner of the at fault vehicle, YOU can be held fully responsible for all damage your vehicle does to someone else. The driver of the vehicle can ALSO be held fully responsible, but any attorney is going to go after the person with more assets/job that they can actually get the money from.
So. You will have to file the civil lawsuit against the driver of your car. You can TRY to file a police report, but 1. you don’t need to and 2. your local police department might not accept a report that’s more than a couple months old.
Can you get into legal trouble, by being the OWNER of this car? Well, you won’t get a ticket. But you ARE responsible for all damages caused by your car. You’re not going to get one red dime from the other driver’s insurance, as they didn’t cause the accident!
